BASIC PRINCIPLES OF THE DATA PROTECTION LAW

PURPOSE

Performing the personal data processing for legal, specific, explicit, and informed purposes to the holder, without the possibility of further processing in an incompatible way with those purposes. Personal data may process only for the purposes it was collected. It must be specified and documented at the time of data collection.


Subsequent changes of purpose from the data collected are only allowed within a minimum limit, for example, if there are legitimate interests of SENDI, as long as observed the legal and specific purposes for the new processing, and the preservation of the personal data holder rights, as well as the fundamentals and principles established in this instrument.

ADEQUACY

Compatibility of the processing with the purposes informed to the holder, according to the processing context

NECESSITY

Processing limitation to the minimum necessary for accomplish its purposes, with coverage of the relevant data, proportional, and not excessive about the purposes of the data processing.


Therefore, it is necessary to make sure that it will collect only the data for the informed purpose. It will exclude the data if it complies with the processing purpose unless it falls under one of the legal hypotheses.

FREE ACCESS

Guarantee to the holders of free and easy consultation about the way and processing duration, as well as about their personal data integrally.

DATA QUALITY

Guarantee to the holders of accuracy, clarity, relevance, and data updating, according to the necessity and the purpose fulfillment of its processing.

TRANSPARENCY

Guarantee to the holders of clear, accurate, and easily accessible information about the realization of the processing and the respective processing agents, observing the commercial and industrial secrets.

SAFETY

Use of technical and administrative measures to protect personal data from unauthorized access and accidental or illicit situations of destruction, loss, alteration, communication, or dissemination.

PREVENTION

Measures adoption to prevent the occurrence of damages due to personal data processing.

NON-DISCRIMINATION

Impossibility of performing the process for discriminatory, illegal, or abusive purposes.

ACCOUNTABILITY AND ACCOUNTABILITY

It’s the demonstration by the processing agent for effective and capable measures of proving the observance and compliance of personal data protection rules and the effectiveness of these measures.
